What is “Builder’s Remedy”?
Under California law, the application for Westridge Hills has met the requirements to qualify as a “Builder’s Remedy” project to ensure a pathway towards obtaining necessary entitlements for development.
“Builder’s Remedy” is a provision in the state’s housing laws specifically linked to the housing element of local governments’ general plans.
It is designed to encourage the construction of affordable housing in areas where local governments fail to meet the required housing production goals, as mandated by the state.
Under California’s Housing Element Law, cities and counties are required to plan for a certain number of new homes (including affordable homes) over an eight- year period.
If a local government fails to adequately plan for this housing or does not meet its housing goals, the “builder’s remedy‘‘ allows developers to bypass certain general plan and zoning requirements.
